FlockWatch Terms of Service

Welcome to FlockWatch. These Terms of Service ("Terms") govern your use of FlockWatch (the "Service"), including our website, surveillance map, and organizing tools. By using FlockWatch, you agree to these Terms. If you don't agree, please don't use the Service.
Please also read our Code of Conduct and Privacy Policy, which are part of your agreement with us.
1. What FlockWatch is
FlockWatch is a platform that maps automated license plate reader (ALPR) and related surveillance infrastructure using publicly available, community-sourced data, and provides tools for people to organize and discover lawful, peaceful protests and civic advocacy against surveillance overreach.
FlockWatch is a tool for organizing lawful activity. It is not a substitute for your own judgment about what is lawful where you are.
2. Who can use FlockWatch
You must be at least 18 years old to use FlockWatch. By using the Service, you affirm that you are 18 or older.
3. Your account
You sign in using your email address. You are responsible for maintaining access to the email account you use and for activity that occurs under your account. Notify us at hello@flockwatch.us if you believe your account has been accessed without your authorization.
4. Acceptable use
You agree to use FlockWatch only for lawful, peaceful purposes, consistent with our Code of Conduct. You agree that you will not use the Service to:
- Organize, promote, or coordinate any unlawful activity, including violence, property destruction, trespassing, or other criminal conduct.
- Use the surveillance map to evade law enforcement while engaged in criminal activity.
- Post another person's private information without consent ("doxxing"), or attempt to identify or expose other users.
- Threaten, harass, stalk, intimidate, or incite violence against any person or group.
- Impersonate any person, organization, or official entity.
- Post fake, false, or misleading events or information.
- Post hateful, discriminatory, or dehumanizing content.
- Scrape, harvest, or extract data or content from the Service outside of normal use.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
- Do anything whose likely effect is to endanger an attendee, organizer, or bystander.
We may remove content and suspend or terminate accounts that violate these Terms or our Code of Conduct.
5. Your content
You retain ownership of the content you post. By posting content, you grant FlockWatch a limited, non-exclusive license to host, display, and distribute that content as necessary to operate the Service.
You are solely responsible for the content you post and for ensuring your use of the Service complies with all applicable laws, including local laws governing assembly, permits, and protest. You represent that you have the right to post the content you share.
6. Privacy
Our collection and handling of your information is described in our Privacy Policy. In short: we collect only your email, we don't track you, and we minimize and delete data wherever we can.
7. Moderation and enforcement
We may, at our discretion, review, remove, or restrict content, and warn, suspend, or terminate accounts that violate these Terms or our Code of Conduct. We aim to weigh intent and context, and to treat honest mistakes differently from bad-faith violations, but we are not obligated to host any content or account.
We are not responsible for monitoring all content and do not guarantee that all violating content will be identified or removed.
8. Third-party data and services
FlockWatch's surveillance map relies on publicly available, community-sourced data (including OpenStreetMap). We do not guarantee the accuracy, completeness, or currency of this data. The Service also relies on third-party infrastructure providers; their availability is outside our control.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information (including map data or event details) is accurate or reliable. You use the Service, and rely on any information from it, at your own risk.
FlockWatch does not organize, endorse, sponsor, or control any event posted by users. Any decision to attend, organize, or participate in an event is yours alone, and you are responsible for your own safety and for complying with the law.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOCKWATCH AND ITS OWNERS, OPERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY CONDUCT OF OTHER USERS OR ANY EVENT ORGANIZED OR DISCOVERED THROUGH THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Indemnification
You agree to indemnify and hold harmless FlockWatch and its owners and operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
12. Termination
You may stop using FlockWatch and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or our Code of Conduct, or as necessary to protect the Service or its users.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and may ask you to re-accept. Your continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Wyoming.
